Chronology of Action

  • November 8, 2024 — Initial concerns raised to HR regarding workplace environment and director conduct.

  • November 8, 2024 — 1st Request for Mediation – in-person with Kayleigh Jones in HR.

  • November 9, 2024 — 2nd Request for Mediation to Kayleigh Jones via email

  • November 9, 2024 — Disability accommodations first referenced in writing; willingness to file noted in email to HR

  • November 11, 2024 — Ongoing harassment by IEA Director Myles Calvert on my work hours (the third week in a row).

  • November 15, 2024 — 3rd Request for Mediation in-person to to Kayleigh Jones in HR.

  • December 4, 2024 — IEA Director continually trying to demean me by assigning tasks beneath my job description.

  • December 9, 2024 — Second medical leave started due to ongoing workplace stress, isolation, and anxiety.

  • December 10, 2024 — Kayleigh Jones – without notice or reason – hands me off to HR director Deb Drain.

  • December 10, 2024 — Deb Drain reaches out (offers no information on my formal mediation request).

  • December 16, 2024 — 4th Request for Mediation via email to Deb Drain in HR.

  • December 16, 2024 — Deb Drain stalls a second time via email without offering other options (such as Kayleigh)

  • December 20, 2024 — Deb Drain stalls a third time via email, claiming she will be available the week after break.

  • January 8 & 9, 2025 — Deb Drain stalls a forth time via email, without her usual of offering no other options.

  • January 13, 2025 — Returned to work remotely (due to lack of mediation).

  • January 15, 2025 — First meeting held with Deb Drain to discuss hostile work conditions.

  • January 15, 2025 — Dean Lauren Lake denied my refund request (retalliation) despite my $2,500 funding allocated to me by former IEA Director Miranda Metcalf—it was only revoked after I filed my first NYSDHR report on the iea Director.

  • January 21, 2025 — 5th Request for Mediation – Second meeting with HR, Deb Drain told me ‘this meeting is about your return to work’ and refused – Union President Ashley Carl joined for transparency and support.

  • January 21, 2025 — Formal ADA accommodations request submitted to HR (handed to Deb Drain).

  • January 27, 2025 — My otherwise loving girlfriend, also AU BFA Alum, abandonded me (because I am, ‘too sad’).

  • January 28, 2025 — revoked my ability to work remotely (retalliation) – began 3rd medical leave due to lack of mediation.

  • February 1, 2025 — 6th Request for Mediation via email to HR

  • February 3, 2025 — Deb Drain emailed me about mediation, ‘I am in the process of … will keep you informed as to next steps.’

  • February 4, 2025 — I request from HR a change of role as to be able to return to work not under the IEA director.

  • February 18, 2025 — Deb finally replies and denies me of my request for alternative placement.

  • February 21, 2025 — Deb requests more information on my needs for accommodations.

  • March 2025 — Preparatory documentation and report drafting begins; HR silent.

  • April 10, 2025 — 7th Request for Mediation – Meeting with Provost Dobie, accommpanied by Professor Sandra Singer and Support Staff Council Head Shanon Yocum – I’m Dismissed in ~15 minutes before any of my concerns are reviewed as the Provost claimed that I had a ‘to-do list’ from HR, that I need to followup with them, and that she can not help me.

  • April 15, 2025 — 8th Request for Mediation – 12-page report, Retaining Top Talent, submitted to HR during third meeting – Sandra Singer attends for transparency and support.

  • April 23, 2025 — Medical paperwork submitted for continued leave and disability extension.

  • May 6, 2025 — 9th Requet for Mediation – 6-page escalation, Provost Briefing, sent, detailing institutional failures.

  • May 6, 2025 — FOIL request sent to Tammy Raub.

  • May 8, 2025 — FOIL request incorrectly denied.

  • May 8, 2025 — FOIL request Rebuttal sent to Tammy Raub.

  • May 10, 2025 — Request for Clarification on HR Investigation Procedures and Oversight, emailed to Tamara Green and Kayleigh Jones with a requested deadline of 5.17.25

  • May 12, 2025 — Termination issued without warning while on protected leave.

  • May 10–14, 2025 — No reply from HR, Provost, or FOIL officer regarding pending filings and documentation.

  • May 14, 2025 — 10th Requet for Mediation RE: I Was Terminated While Asking for Mediation Letter to President Zupan hand-delivered, requesting intervention and responses to all my requests.

  • May 15, 2025 — No response from Tammy Raub from my FOIL request within the 5 day timeline required by law

  • May 17, 2025 — No response from HR on my May 10th request for clarity on investigations by my imposed deadline

  • May 17, 2025 — No response from the Provost on my May 6th Provost Briefing by my imposed deadline

  • May 23, 2025 — Sent a followup email to the President reminding him of tomorrows deadline, Cc’d 20+ AU connections

  • May 24, 2025 — 18-day expected reinstatement deadline issued to Provost Dobie in my 5.6.25 Provost Briefing

  • May 24, 2025 — 10-day expected response deadline issued to President Zupan.
